These Terms and Conditions ("Agreement") govern your access to and use of the CrewVision platform, including the Admin Portal at http://app.crewvision.io , iOS and Android mobile applications, interactive maps, and any related services (collectively, the "Service"), provided by CrewVision Inc. ("CrewVision," "we," "us," or "our").
By accessing, registering for, or using the Service, you agree to be bound by this Agreement. If you are entering into this Agreement on behalf of a company or other legal entity, you represent and warrant that you have the authority to bind that entity.
If you do not agree to these terms, you must not access or use the Service.
1. Services Provided
CrewVision is a cloud-based workforce management tool designed for field service industries such as landscaping, snow removal, cleaning, and similar operations. Core features include:
Real-time GPS tracking and geofencing
Interactive property mapping with Pins, Service Areas, and Child Maps
Crew, asset, and equipment assignment and management
On-site job execution tools, including Instructions Tab and Media Gallery (photos, notes)
Dispatch and routing support
Data reporting and payroll export functionality (e.g., XLSX)
2. User Accounts & Access Requirements
To use the Service, particularly the mobile applications, you must:
Create an account with accurate, current, and complete information.
Maintain the confidentiality of your account credentials; you are responsible for all activities under your account.
Mobile Application Access Requirements
Access to the iOS/Android mobile apps requires:
A session-specific OTP (One-Time Password) access code delivered via SMS to your registered mobile phone number through a local domestic SMS provider. Each OTP is valid for 4 hours and is required per login session for security and identity verification.
Installation of the official CrewVision mobile app from the Apple App Store (iOS) or Google Play Store (Android). Keep the app updated for security, performance, and feature access.
Location Services
For optimal functionality and required for higher-end features (e.g., real-time dispatch, geofencing alerts, accurate GPS tracking during active sessions, interactive on-site maps):
Enable location services (GPS) on your device and grant the app permission when prompted.
You are responsible for ensuring location access is enabled as needed.
We collect and use location data (including geo location) in accordance with our Privacy Policy and the Telephone Consumer Protection Act (TCPA) and applicable FCC regulations in the United States.
2a. SMS Communications
CrewVision uses SMS solely to deliver One-Time Passwords (OTPs) for secure login authentication. By providing your mobile phone number and registering for the Service, you consent to receive transactional SMS messages from CrewVision.
Frequency: Message frequency depends on login activity (one OTP per login session).
Rates: Message and data rates may apply. Carriers are not liable for delayed or undelivered messages.
No Marketing: SMS messages from CrewVision are strictly transactional (OTP delivery) and will never be used for promotional or marketing purposes.
US Compliance: SMS communications comply with the Telephone Consumer Protection Act (TCPA) and applicable FCC regulations.
3. Data Ownership & Privacy
You retain ownership of any data you upload or create using the Service, including photos, property maps, Pins, Service Areas, Child Maps, employee records, notes, and other content ("Customer Data").
You grant CrewVision a limited, worldwide, non-exclusive, royalty-free license to host, store, process, back up, display, and use Customer Data as necessary to provide, maintain, secure, and improve the Service.
Collection, use, disclosure, retention, and protection of personal information (including name, contact details, geo location data for aggregate statistics, IP addresses, browser data, and other provided information) are governed by our Privacy Policy, available here:
https://privacy.crewvision.io (incorporated into this Agreement by reference).
We may use anonymized or aggregated data (e.g., usage statistics, geo location aggregates, functions used) for analytics, product enhancement, and features such as AI-driven insights.
Account Holder’s Responsibility
The account holder is responsible for obtaining all necessary consents from your employees, contractors, or other individuals for GPS/location tracking, SMS delivery of OTPs, or other data collection during work activities, in compliance with applicable labor, privacy, and telecommunications laws.
Compliance with Privacy Laws
We process personal information in compliance with applicable privacy laws, including the Personal Information Protection and Electronic Documents Act (PIPEDA) in Canada and and the Telephone Consumer Protection Act (TCPA) and applicable FCC regulations in the United States, and where relevant, the General Data Protection Regulation (GDPR) in the European Union. Our Data Protection Officer (or equivalent privacy contact) can be reached at support@crewvision.io for inquiries related to data protection, access requests, or compliance.
Third-Party Services
The Service may integrate with or rely on third-party providers (e.g., SMS delivery services for OTPs, app stores, mapping data sources, or payment processors). We do not control, endorse, or assume responsibility for the content, privacy practices, availability, security, or terms of these third-party services. Your use of any third-party features is at your own risk and subject to their separate terms and conditions.
4. Subscription & Payments
Access to the Service requires a paid subscription (monthly or annual plans). Fees, features, and limits are as described in your order confirmation or on our website.
All fees are non-refundable except as expressly stated or required by law.
We may suspend access if payments are more than 30 days overdue.
Pricing or plan changes will be notified in advance via email or in-app; continued use constitutes acceptance.
You are responsible for any applicable taxes.
5. Acceptable Use & Prohibited Conduct
You agree to use the Service only for lawful internal business purposes. You must not:
Reverse engineer, decompile, disassemble, or attempt to discover source code (including mapping or property editor technology).
Track individuals outside of professional work hours or without required consents.
Upload viruses, malware, harmful code, or attempt unauthorized access to systems or data.
Violate any applicable law, regulation, or third-party rights.
Use the Service in any way that interferes with its operation or other users.
We may monitor use for compliance and suspend or terminate access for violations.
6. Intellectual Property
The Service, including software, designs, interfaces, trademarks, and content (excluding Customer Data), is owned by CrewVision or its licensors and protected by intellectual property laws.
You receive a limited, non-exclusive, non-transferable license during your active subscription term for internal use, subject to this Agreement.
7. Limitation of Liability & Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy of GPS/mapping data, or non-infringement.
We do not warrant uninterrupted access, error-free operation, or that outputs (e.g., payroll exports, map accuracy) will meet your specific needs—you must verify all outputs before use.
To the maximum extent permitted by law, CrewVision is not liable for indirect, incidental, special, consequential, or punitive damages (including lost profits, data loss, business interruption), even if advised of the possibility.
Our total aggregate liability shall not exceed the fees paid by you in the 12 months preceding the claim.
8. Indemnification
You agree to indemnify, defend, and hold harmless CrewVision, its officers, directors, employees, agents, successors, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees and disbursements) arising out of or relating to:
Your or your authorized users' breach of this Agreement;
Your or your authorized users' violation of any applicable law, regulation, or third-party rights (including privacy, labor, or telecommunications laws related to location tracking, GPS data, SMS consents, or employee monitoring);
Any claim based on Customer Data or your use of the Service.
We will provide prompt notice of any such claim and reasonable cooperation in the defense or settlement thereof (at your expense). You will not settle any claim that imposes liability on CrewVision without our prior written consent.
9. Termination
Either party may terminate this Agreement:
With 30 days' written notice (for convenience, subject to any minimum term in your subscription).
Immediately for material breach (with notice and opportunity to cure where required).
Upon termination:
Your access ends immediately.
You have 14 days to export your Customer Data.
After that period, data may be deleted from active servers (subject to legal retention obligations).
10. Governing Law & Dispute Resolution
This Agreement is governed by the laws of the Province of Ontario and applicable federal laws of Canada, without regard to conflict of laws principles.
Any disputes shall be resolved exclusively in the courts located in Toronto, Ontario.
11. Changes to This Agreement
We may update this Agreement from time to time. Material changes will be notified via email, in-app notification, or posting on our website/help center. Your continued use after the effective date constitutes acceptance.
12. Severability and Waiver
If any provision of this Agreement is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions will remain in full force and effect to the fullest extent permitted by law.
The failure of either party to enforce any right or provision of this Agreement will not constitute a waiver of that right or provision, nor will it prevent future enforcement of that right or provision.
